## Summary

Document confirming lender's lien has been released after payoff.

## Content

Lien release is the documentation a lender files when their security interest in your equipment has been satisfied (loan paid off, equipment sold with lender consent, or other resolution). The release removes their claim from public records, freeing the equipment to be sold, refinanced, or used as collateral for new financing.
What lien release looks like

For UCC-1 perfected equipment: the lender files a UCC-3 termination statement with the state Secretary of State
For titled equipment (trucks, trailers, vehicles): the lender files a lien release form with the state DMV; the title is reissued without the lender as lienholder
For real estate-related liens: the lender records a satisfaction of mortgage at the county recorder

When lien release happens

Loan paid in full: at the final scheduled payment, or via prepayment
Equipment sold with lender consent: lender releases lien at closing of the sale; new owner takes clear title
Refinance: old lender releases lien when the new lender's loan funds and pays off the old loan
Settlement: if the lender agrees to release the lien in exchange for partial payment or other consideration

Why this matters to borrowers
Lien releases should happen within 30-60 days of payoff. If your lender does not file the release:

The lien continues to appear in public records, making future financing harder
Title for titled equipment is not transferable to a new owner
Other creditors may dispute your unencumbered ownership of the equipment

What to do if lien release is delayed

Request a payoff confirmation letter from the lender at payoff
Follow up at 30 days post-payoff if no UCC-3 or DMV release has been filed
At 60 days, send a formal demand letter (most state UCC statutes provide remedies for failure to file timely)
If still no release at 90 days, file a complaint with state regulators or pursue legal remedy

UCC-3 specifics
The UCC-3 termination statement clears the original UCC-1 financing statement. Once filed, the public-records search will show the original UCC-1 with a "terminated" annotation. Some search systems show terminated UCC-1s alongside active ones, so future lenders should still be able to see the history (and the resolution).
